Businesses regularly look for ways to reduce overhead. One highly sought after mechanism is to utilize Independent Contractors as opposed to employees. Unfortunately, due to the complexities in the law, businesses often misclassify individuals, which can result in harsh penalties. This presentation examines the various tests used under California and Federal law for determining whether a service provider is properly categorized as an Independent Contractor or employee. With this knowledge, all sides of the equation will be better equipped to ensure they do not face the negative consequences of misclassification.
